La luz verde a este discutido proyecto de ley, se dio gracias a los 91 votos a favor que recibió, ninguno en contra y 11 abstenciones. Ahora el Congreso deberá enviar el dictamen al Ejecutivo para que lo apruebe o en su defecto, lo observe.
El Proyecto de Ley N°6863, busca suspender de manera provisional el curso de los procesos concursales de los clubes, considerando las facultades de junta de acreedores y demás.
Asimismo, se establecerá una Comisión de Alto Nivel, que tendrá 45 días para elaborar y proponer un nuevo marco legal sobre la ley concursal. Mientras ello ocurra, será la SUNAT la que tome la presidencia de las juntas de acreedores y designe a un administrador.
En la actualidad, los clubes que se encuentran en procesos concursales son Alianza Lima, Universitario de Deportes, Melgar, Cienciano y Sport Boys.
Sin embargo, esta norma no alcanza a todos los involucrados antes mencionados, ya que solo está dirigido a aquellos clubes, en los que terceros no hayan adquirido la mayoría simple de acreencias concursales tributarias, como ha ocurrido con Alianza Lima y Melgar.
De esta manera, las instituciones directamente afectadas son Universitario de Deportes, Cienciano y Sport Boys, que mientras dure esta medida adoptada, no verán peligrar sus activos, los cuales no serán tocados para cubrir algún tipo de deuda.
Asimismo, las deudas determinadas por Indecopi volverán a ser calculadas, esto bajo la supervisión de una Comisión de Alto Nivel que será conformada por representantes del Congreso, de los clubes involucrados y del IPD.
